Press Release – Burglary and Menacing

On January 8, 2018 at around 11:30 pm members of the Schodack Police Department responded to a reported burglary in progress at 1346 Maple Hill Road. The victim reported that her ex-boyfriend, James M. File, 46 of 11 Alter Alley Way, Nassau, NY, had broken into her house shortly after she arrived home and confronted her. When the victim tried to use her cell phone to call 911, File grabbed the phone out of her hand and left the residence with it. The victim used her home telephone to call 911. File then left. Officers were on their way to arrest File for this incident when 911 dispatchers received a new call that File was back at the residence. File had a handgun and was menacing the victim with it. A Rensselaer County Deputy Sheriff patrol was nearby and was dispatched to respond as well. The deputy sheriff was in the residence when Schodack Police units arrived. File had relinquished his firearm and surrendered to the deputy sheriff without resistance. File is facing charges of Burglary in the first degree, Burglary in the third degree, Robbery in the third degree, Reckless Endangerment in the first degree, all felonies and Menacing in the second degree and Criminal Possession of Stolen Property in the fifth degree both misdemeanors. Other criminal charges may be possible. File was arraigned before Town of Schodack Justice Paul Peter and remanded to Rensselaer County Jail without bail. File is scheduled to return to Schodack Town Court for a preliminary hearing on Friday January 12th, 2018 at 1:00pm.
